The company “HELLENIC FUELS MINERAL OILS SOLE INDUSTRIAL AND COMMERCIAL COMPANY ANONYMOUS” with its registered office in Maroussi, Attica, 8A Himarras, 15125 (hereinafter referred to for the sake of brevity as “EKO SA” or “Organizer”), in collaboration with the advertising company with the name “THE NEWTONS LABORATORY SA” (hereinafter referred to as “THE NEWTONS”) with its registered office in Chalandri, Attica, 57 Ethnikis Antistaseos Street, (jointly referred to as “The Companies”), are organizing a promotional action via the Internet entitled “EKO SMILE COMPETITION – CRUISE IN THE ARGOSARONIKO” in the context of promoting the products and services of the Organizer. By participating in the competition, all participants fully and unreservedly accept the following terms:
1. Right to Participate – Conditions1.1. The right to participate in the promotion is open to those who have reached the age of 18, are residents of Greece and have legal capacity. Employees and representatives of the company “THE NEWTONS LABORATORY S.A.” of “EKO SA” as well as its affiliated companies, as well as their first and second degree relatives, their spouses or anyone else professionally related to the said promotion are excluded.
1.2. A necessary condition for someone to take part in the promotional action, other than those defined above, is a) have a personal Instagram account while participation in the promotional action presupposes and implies acceptance of Instagram’s terms of registration, its privacy and security policy and consequently the waiver of any relevant claim against Instagram in relation to this promotional action and b) have fully completed their registration in the EKO Smile customer loyalty program via the promotional code: EKO24 according to its terms and conditions during the competition period from 10/10/2024 to 14/10/2024 at 14.00.
1.3. Participation in the promotional action requires interested parties to have access to the internet using their own technical means and to complete their registration in the EKO Smile program. The “Companies” do not undertake any obligation regarding the provision, assistance of access to internet spaces or the provision of facilities to any interested party. Access to the promotional website is permitted only under the operating conditions of the relevant server and the technical and other conditions and specifications. Furthermore, the “Companies” are not responsible for any burden on the participating users for the above reasons.
1.4. Participation in this promotional action does not require the purchase of products from the Organizer or the risking of any amount of money in any way by the participants for the purpose of profit.
4. PrizesThe prize offered to be drawn in the Competition is defined in the relevant Instagram Post announcing the competition and includes one (1) one-day cruise in the Argosaronic Gulf for 1 lucky person, valid until 30.06.2025
2.2. Entries submitted within the promotional time limits are considered valid and after the expiry date of the aforementioned promotional action, no entry will be accepted.
2.3. The Organizing Company reserves the right to modify, limit or extend the duration of the promotional action, by amending these terms. This modification will be effective automatically from its publication on the promotional action page.
2.4. Entries submitted after the expiry of the initial and/or shortened and/or extended deadline for participation in this promotional action, in accordance with the above, will be considered automatically null and void and will no longer have any effect against anyone, while they do not create any type of right in favor of the participant. 2.5. The Start and End Time of the promotional action, the time of active submission of the participation and receipt of any point, as well as the measurement of all indications related to the promotional action will be based on the electronic computers that will be used for this purpose by the Organizer and not on the respective indications of the participants’ computers.
3. Participation in the actionMore specifically, in order to take part in this promotional action, each interested party is invited to register via the promotional code: ΕΚΟ24 in the ΕΚΟ Smile reward program and to accept the terms of registration of the program that will be received by SMS to complete their registration and, on the other hand, to follow @eko_greece, i.e. the ΕΚΟ account on Instagram, on the following page https://www.instagram.com/eko_greece /. Entries submitted within the time limits of the promotional action are considered valid. 4. PrizesThe prize offered to be drawn in the Competition is defined in the relevant Instagram Post announcing the competition and includes one (1) one-day cruise in the Argosaronic Gulf for 1 lucky person, valid until 30.06.2025
The gift that will be made available by the Organizer within the framework of this promotional action, is defined as above and its exchange with other gifts or its redemption with cash is excluded. Also, the gift is personal and non-transferable. In case of assistance due to force majeure, security reasons or other circumstances beyond the control of the “Companies” or third parties, the “Organizer” may and is entitled NOT to offer the Gift, in which case it will be exempted from any liability and will not be obliged to offer an alternative gift of any form and value.
Furthermore, it is clarified that the Organizer bears no responsibility and the winners do not retain any claim, claim or right against it in the event that due to force majeure, such as indicatively mentioned weather conditions, port strike, general strike, etc., it is not possible to carry out the one-day excursion by speedboat within the framework of the offered gift. Also, the Organizer bears no responsibility and the winners do not retain any claim, claim or right against it, for covering any expenses due to cancellation or cancellation of the excursion as mentioned above. Also, and only for the above reasons, the Organizer may and is entitled NOT to offer the winners the Gifts or other alternative gifts, in which case it will be exempted from any responsibility and will not be obliged to offer alternative gifts of any form and value.
5. Winners Selection5.1. The winner will be selected on Monday 14/10/2024, at the headquarters of THE NEWTONS, which has undertaken the advertising promotion of this promotional action (Chalandri Attica, 57 Ethnikis Antistaseos Street) following the collection of usernames and registrations in EKO Smile via an electronic platform for generating random codes (electronic lottery). The “Companies” are entitled to cancel the lottery or change the date of its holding. The above electronic lottery will select one (1) winner and three (3) alternate runners-up in the event that for any reason it is not possible to contact them or they do not accept their gifts. By accepting the gift, each winner will also accept the terms and conditions governing the excursion. The winner will be notified via the page maintained by the Organizer on the social networking website. https://www.instagram.com/eko_greece/.
5.2. The winner will be asked to contact the Organizer within 24 hours of the announcement by sending a personal message on the above website and to provide their other contact details. The Organizer is not liable for any damages of any kind – nature, related to the voluntary publication by the participant/visitor of personal data or other sensitive information. In any cases of this kind, the participants/visitors accept full and exclusive responsibility for any possible consequences, even in the case of malicious harassment by third parties. In the event that the winner, whose name has been announced, does not contact the Organizer within the time limit as above and/or does not accept the gift offered to him/her, he/she will automatically and ipso jure lose the gift permanently, and the first runner-up will be called in their place to contact and accept it, using the aforementioned procedure. In the event that he/she also does not contact the Organizer or does not accept the gift offered to him/her, then the second runner-up will be called in his/her place. If it is not possible to contact the winners for any reason not due to the Organizer’s fault by the day provided for in these terms, the Organizer is released from any obligation towards the specific winners and the Organizer reserves the right to dispose of the prize(s) at its discretion that was not claimed and/or not received in a timely manner by the winner(s), in which case it is released from any obligation towards the respective winner(s).
5.3. In any case, any of the winners, at any stage – even during the stage of awarding the prizes – may be cancelled for the following reasons: (a) in case they do not meet these terms in their entirety, all of which are considered essential, (b) due to an impediment under these terms, (c) in case for any reason it is not possible to contact them within the predetermined deadlines set out in these terms and (d) if they do not present a legal document proving their identity and age upon receipt of the Prize.
6. Personal data – Declaration of consentBy registering with EKO smile as specifically defined in points 1 to 3 above, participants declare their understanding of these terms in their entirety and provide their explicit and clear consent, within the meaning of Regulation (EU) 2016/679 (General Data Protection Regulation), as applicable, to the collection of their personal data and their processing for the needs of conducting the program, namely for the purposes of 1. organizing and completing the draw and 2. informing and communicating with participants and in particular the winners of the competition, exclusively regarding the program. The Organizing Companies will process the personal data of the participants exclusively and only for the above purposes of the program. The personal data of the participants will not be disclosed to third parties and will not be transferred outside the European Economic Area. The personal data of the winners will be kept until the delivery of the Gift as described above. After the delivery of the Gift, as defined in these Detailed Terms, the relevant data will be destroyed. The Organizer is the Data Controller of the participants’ personal data and only processes data relating to contact details (e.g. Instagram direct message, telephone number) and personal details of the participants (e.g. name, surname, location).
Each participant has the right to access, update, rectify, object to the further processing of his/her personal data and portability, as provided for in the General Data Protection Regulation. To exercise his/her rights, the participant may contact the Organizing Companies at the contact details provided below. At any time, the participant may freely withdraw his consent and request deletion of his personal data.

Any issues of personal data breaches that concern the Instagram website/platform exclusively, such as, but not limited to, malware, identity theft, phishing and any other form of cyberattacks, do not concern the Organizing Companies.
7. Amendment of TermsThe Organizer reserves the right to amend these terms, to shorten or extend the duration of this promotional action or to withdraw it with prior notice by any appropriate means, and also to replace the gift with another of equal value at its discretion and in general to amend any term of the promotional action by timely informing the participants by announcement via the page https://www.instagram.com/eko_greece/.
8. Organizer’s Disclaimer8.1. The Organizer shall not be liable in the event that participants disregard the terms and participants agree to fully indemnify the Organizer against any claims by any third party arising from any breach of these terms. The Organizer shall not be liable for any damage arising on INSTAGRAM and the page https://www.instagram.com/eko_greece/.
8.2. The Organizer bears absolutely no responsibility if, for reasons beyond its sphere of influence and control, the receipt of entries fails or is delayed or, finally, if the records kept by it are destroyed, partially or completely.
8.4. It is clarified that this promotional action is not carried out by Instagram, nor is it sponsored or otherwise sanctioned or associated with Instagram and therefore Instagram bears no responsibility for any claim or demand of a participant or any third party arising from or in connection with this Competition.
9. Acceptance of the terms – Consent9.1. Participation in this promotion presupposes and implies the unconditional acceptance of all the terms herein.
9.2. Participants acknowledge and unconditionally accept that the operation of the above-mentioned page of the Organizer may be affected or temporarily interrupted due to network problems. More generally, participation in the promotional action may be subject to changes or interruptions that depend entirely on the capabilities of both the social networking website in question and the existing technology on which they are based and which are beyond the control and responsibility of the Organizer, which bears no responsibility for all the above reasons. If it is proven that a participant has been declared a winner in violation of the terms of this, by fraudulent means, he will not be awarded his prize or will automatically lose any right to possess it, and the Organizer in this case reserves all its rights against the said participant.
10. Intellectual PropertyParticipants do not have or acquire any rights whatsoever over the trademarks, names, indications, emblems and other insignia of the companies and Instagram and any modification, publication, transmission, transfer, reproduction, distribution, presentation, linking, downloading or otherwise exploiting, in whole or in part, in any way or by any means for commercial or other purposes, without the prior written permission of the beneficiary, is prohibited.
11. Jurisdiction – Applicable LawAny dispute arising in connection with this promotion will be referred exclusively to the Courts of Athens and Greek Law will apply.
12. PublicityThese terms and conditions will be posted throughout the duration of the promotional campaign on the page maintained by the Organizer on the website https://www.instagram.com/eko_greece/.
